1. General

These Terms & Conditions ("Terms") govern the use of the website operated by Kwik Buy ("we", "us", "our"), a business registered in Belgium with VAT number BE1001488871, and all purchases made through it.

By accessing our website or placing an order, you ("Customer", "you", "your") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

These Terms are governed by and shall be interpreted in accordance with Belgian law and applicable European Union legislation, including but not limited to Directive 2011/83/EU on consumer rights and Directive 2019/771 on the sale of goods.

2. Definitions

  • "Website" refers to the online platform operated by Kwik Buy, accessible at the domain where these Terms are published.
  • "Products" refers to all goods offered for sale through the Website.
  • "Order" refers to a request placed by the Customer to purchase one or more Products through the Website.
  • "Consumer" refers to any natural person acting for purposes outside their trade, business, craft, or profession, as defined by EU Directive 2011/83/EU.
  • "Contract" refers to the binding purchase agreement formed when we confirm acceptance of your Order.

3. Products & Services

We operate as an e-commerce retailer, offering a curated selection of products sourced from trusted suppliers worldwide. All product descriptions, images, and specifications are provided in good faith and are as accurate as reasonably possible.

We reserve the right to modify, discontinue, or update our product catalogue at any time without prior notice. In the event that a product you have ordered is no longer available, we will inform you promptly and offer a full refund.

While we endeavour to display product colours and imagery as accurately as possible, we cannot guarantee that your device's display accurately reflects the actual appearance of the product. Minor variations in colour or design shall not constitute a defect.

4. Pricing & Payment

All prices displayed on the Website are in Euros (EUR) and include Value Added Tax (VAT) at the applicable Belgian rate, currently 21%. The VAT amount is clearly indicated during the checkout process, in accordance with EU consumer protection requirements.

We reserve the right to change prices at any time. However, price changes will not affect Orders that have already been confirmed. In the unlikely event of a pricing error, we will contact you before processing your Order and offer you the option to proceed at the correct price or cancel.

Payment is processed securely through Stripe, our third-party payment processor. We accept major credit and debit cards. We do not store your payment card details on our servers. All transactions are encrypted and handled in compliance with PCI DSS standards.

A Contract is formed when you receive an Order confirmation email from us. Until that point, your Order constitutes an offer to purchase, which we may accept or decline at our discretion.

5. Shipping & Delivery

We ship to all 27 EU member states. Estimated delivery times are provided at checkout and vary depending on your location and the product ordered. Delivery times are estimates only and do not constitute guaranteed delivery dates.

In accordance with Article 18 of Directive 2011/83/EU, we will deliver goods without undue delay and no later than 30 days from the conclusion of the Contract, unless a different delivery period has been agreed upon. If we fail to deliver within this period, you are entitled to set an additional reasonable deadline. If delivery still does not occur, you may terminate the Contract and receive a full refund.

Risk of loss or damage to the Products passes to you upon physical delivery. If you arrange your own carrier (not offered by us), risk passes upon handover to that carrier.

Shipping costs, if applicable, are displayed before you confirm your Order. Any customs duties or additional import charges for deliveries outside the EU are the responsibility of the Customer.

6. Right of Withdrawal

In accordance with Articles 9-16 of EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from your purchase within 14 calendar days from the day on which you, or a third party designated by you (other than the carrier), physically receive the goods, without giving any reason.

To exercise your right of withdrawal, you must inform us of your decision by means of an unambiguous statement (e.g., a letter sent by post or email). You may use our contact form or send an email to our customer service team. You may also use the model withdrawal form provided by Annex I(B) of Directive 2011/83/EU, although this is not mandatory.

Upon withdrawal, you must return the goods without undue delay and in any event no later than 14 days from the date on which you communicated your withdrawal. You shall bear the direct cost of returning the goods unless we have agreed to bear that cost or have failed to inform you that you must bear it.

We will reimburse all payments received from you, including the costs of standard delivery, without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.

7. Legal Guarantee & Warranty

Under EU Directive 2019/771 on the sale of goods, you benefit from a legal guarantee of conformity of 2 years from the date of delivery. This means that we are liable for any lack of conformity that becomes apparent within 2 years of delivery.

During the first year following delivery, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery, unless the nature of the goods or the nature of the lack of conformity is incompatible with this presumption. After the first year, the burden of proof may shift to the Consumer.

If a product is found to be non-conforming, you are entitled to have the goods brought into conformity free of charge, by repair or replacement. If repair or replacement is impossible or disproportionate, you may request an appropriate reduction in price or termination of the Contract.

8. Limitation of Liability

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully limited or excluded under Belgian or EU law.

Subject to the foregoing, our total liability arising out of or in connection with your use of the Website or any Contract shall not exceed the total amount paid by you for the specific Order giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Website or Products, to the maximum extent permitted by applicable law.

We shall not be held liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control (force majeure), including but not limited to natural disasters, war, pandemic, strikes, or disruptions to transportation or supply chains.

9. Governing Law & Dispute Resolution

These Terms and any Contract between you and Kwik Buy are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions, and in compliance with applicable European Union legislation.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium, unless mandatory consumer protection rules in your country of residence provide otherwise.

In accordance with EU Regulation 524/2013, we inform you that the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr. This platform allows consumers and traders to resolve disputes regarding online purchases without going to court. We are willing to participate in an out-of-court dispute settlement procedure before a consumer arbitration body.

As a consumer, you always retain the right to invoke the mandatory consumer protection provisions of the law of the EU member state in which you reside, regardless of the governing law chosen in these Terms.
