1. Your EU Legal Guarantee
As a consumer purchasing from Kwik Buy, an EU-based business registered in Belgium, you are entitled to a legal guarantee of conformity of 2 years from the date of delivery of the goods. This guarantee is provided under EU Directive 2019/771 on certain aspects concerning contracts for the sale of goods, as transposed into Belgian national law.
This legal guarantee exists independently of, and in addition to, any commercial warranty that may be offered by the manufacturer. It cannot be waived or limited by contract.
Under this guarantee, we are responsible for ensuring that the goods you receive conform to the contract of sale. A product is considered to be in conformity when it meets the following criteria, as set out in Articles 6 and 7 of Directive 2019/771:
- It corresponds to the description, type, quantity, and quality specified in the contract.
- It is fit for any particular purpose made known to the seller at the time of the conclusion of the contract, and which the seller has accepted.
- It is delivered with all accessories and instructions as stipulated in the contract.
- It is fit for the purposes for which goods of the same type would normally be used.
- It possesses the qualities and features that are normal for goods of the same type and that the consumer may reasonably expect, given the nature of the goods and any public statements made about them.
2. What Is Covered
The 2-year legal guarantee covers any lack of conformity (defect) that existed at the time of delivery. This includes:
- Manufacturing defects or flaws in materials that prevent the product from functioning as described.
- Products that do not match their description, including product listings, images (accounting for reasonable display variations), or specifications provided at the time of purchase.
- Products that are not fit for the ordinary purpose for which goods of the same type are used.
- Products that do not possess the qualities or performance capabilities that the consumer may reasonably expect.
- Products delivered with missing parts, accessories, or instructions that were included in the contract.
Burden of Proof
In accordance with Article 11 of Directive 2019/771, during the first year after delivery, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery. This means you do not need to prove the defect was present at delivery during this period. After the first year, you may be required to demonstrate that the defect existed at the time of delivery.
3. What Is Not Covered
The legal guarantee does not cover defects or damage resulting from:
- Normal wear and tear arising from ordinary use of the product.
- Misuse, abuse, negligence, or failure to follow the manufacturer's instructions for use or care.
- Accidental damage, including drops, impacts, exposure to liquids, extreme temperatures, or other external factors.
- Unauthorised modifications, repairs, or alterations made by anyone other than an authorised service provider.
- Defects that you were made aware of, or should reasonably have been aware of, at the time of purchase.
- Consumable components (such as batteries, filters, or cartridges) that are expected to diminish over time through normal use.
4. How to Make a Warranty Claim
If you believe your product has a defect covered by the legal guarantee, please follow these steps:
- Contact us: Reach out to our customer service team through our contact form with the subject "Warranty Claim". Please include your order number and a detailed description of the defect.
- Provide evidence: Where possible, include photographs or videos clearly showing the defect. This helps us assess your claim more quickly and accurately.
- Assessment: Our team will review your claim and respond within 5 business days. We may request additional information or ask you to return the product for inspection.
- Resolution: If the defect is confirmed to be covered under the legal guarantee, we will offer you a remedy in accordance with your rights (see Section 5).
Please retain your order confirmation email or receipt as proof of purchase. This will be required to process your warranty claim.
5. Your Remedies Under EU Law
Under Articles 13-16 of EU Directive 2019/771, if a product is found to lack conformity, you are entitled to the following remedies, free of charge:
5.1 Repair or Replacement (First Tier)
You may choose to have the goods repaired or replaced, unless the chosen remedy would be impossible or would impose disproportionate costs on us compared to the alternative remedy. Repair or replacement shall be carried out within a reasonable time and without significant inconvenience to you, taking into account the nature of the goods and the purpose for which you required them.
5.2 Price Reduction or Contract Termination (Second Tier)
You are entitled to a proportionate reduction in price, or to terminate the contract and receive a full refund, in the following circumstances:
- Repair or replacement is impossible or disproportionate.
- We have failed to complete repair or replacement within a reasonable time.
- A repair or replacement would cause significant inconvenience to you.
- The lack of conformity is so serious as to justify an immediate price reduction or contract termination.
You are not entitled to terminate the contract if the lack of conformity is minor, unless we have failed to remedy the situation.
6. Your Consumer Rights Under EU Directive 2019/771
EU Directive 2019/771 on certain aspects concerning contracts for the sale of goods provides a harmonised framework for consumer protection across all EU member states. Key provisions include:
- Article 10 – Liability of the seller: The seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within 2 years.
- Article 11 – Burden of proof: During the first year, the lack of conformity is presumed to have existed at the time of delivery.
- Article 13 – Repair or replacement: The consumer has the right to have goods brought into conformity free of charge by repair or replacement.
- Article 14 – Price reduction and termination: Where repair or replacement is not feasible, the consumer may request a price reduction or terminate the contract.
These rights represent the minimum level of protection. Your national law may provide additional rights or longer guarantee periods. Nothing in this warranty policy affects any statutory rights you may have under the laws of the EU member state in which you reside.
